The Gabriela Mistral University Library has developed the following Academic Repository in order to preserve, disseminate and make available the full-text contents of the academic production developed by the different actors in the academic and research field of the University.

dc.description.abstractBien es sabido que le derecho civil chileno enfrenta una crisis de congruencia normativa en materia de capacidad. Mientas el Código Civil califica a los “dementes” como incapaces absolutos, basado en la sustitución de voluntad (Artículo 1.447, Código Civil), la Convención sobre los Derechos de las Personas con discapacidad (CDPD), ratificada por chile en el año 2.008, exige que se reconozca en forma plena la capacidad jurídica y se implementen sistemas de apoyo (Artículo 12, CDPD). Este enfrentamiento de normas no descansa solo en lo teórico; impacta directamente en la judicatura donde coexisten fallos que aplican en forma estricta la interdicción, con otros que la rechazan en virtud de la convención.es_ES
