| dc.description.abstract | En la actualidad muchas personas para poder cumplir sus fines económicos tienen que recurrir a terceros para poder obtener recursos, como por ejemplo dinero. Ya sean particulares o bancos, generalmente le van a exigir al deudor que garantice la obligación. Este podrá elegir distintas cauciones, ya sean reales —hipoteca y prenda- y personales —fianza-. A pesar de ser la gratuidad un requisito de la esencia de la fianza, esto no significa que el fiador quiera ni está dispuesto a pagar con su patrimonio una deuda ajena, y para ello el derecho le ha entregado varias herramientas para poder defenderse del acreedor, entre ellos el beneficio de excusión. | es_ES |
